1. Addressed group of persons – scope

This Internet portal including its information, statements, documents, etc. is oriented to all of its visitors, but the Internet portal and its use are entirely subject to the legal system of SAR Hong Kong. Oxyvital Limited. (hereafter referred to as “Oxyvital”) therefore cannot be held liable for any violations, any usage restrictions for portal users or illegal activities when using this Internet portal. This especially applies to users following other legal systems.

2. Right to change

Oxyvital expressly reserves the right to change, supplement or delete parts of the sites or the whole offer without making a separate announcement or to suspend the publication temporarily or finally. All offers are without obligation and non-binding.

3. Copyright and trademark law

Oxyvital endeavors in all publications to comply with the copyrights of the graphics, sound documents, video sequences and texts. In all other cases Oxyvital uses self-created or license-free material. All trademarks and brands named within the Internet presence and if applicable protected by third parties are subject to the provisions of the respective valid trademark law and the property rights of the respective registered owners without any limitation. The conclusion cannot be drawn solely based on the mere naming that trademarks are not protected by rights of third parties. The copyright for published objects, created by Oxyvital itself, shall remain solely with Oxyvital; a reproduction or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications are not permitted without the express consent of Oxyvital.

4. Data protection

Insofar as there is the possibility to enter personal or business data (e-mail addresses, names, addresses) within the Internet offer then these data are expressly disclosed voluntarily by the user. Oxyvital is aware that a particularly sensitive handling of all personal data, which the users transmit to Oxyvital, is extremely important for the users. Therefore, Oxyvital shall comply with all relevant statutory data protection stipulations. Oxyvital shall not forward the personal and business data of the users to third parties without authorization or allow third parties to gain knowledge thereof in any other manner. The use of the contact data, which are published within the framework of the masthead or comparable details, such as e.g. postal addresses, telephone and fax numbers as well as e-mail addresses by third parties for sending information, which was not expressly requested, is not permitted. The right is expressly reserved to take legal steps against the sender of so-called Spam mails in case of breaches of this ban. Details concerning the processing of the personal data of the users by Oxyvital are regulated in the additionally applicable data protection declaration of Oxyvital.

5. Security instructions

The use of the Internet and these websites inevitably involve security risks. Despite the use of state-of-the-art technology and encoding processes Oxyvital cannot guarantee that confidential data of the user cannot be viewed without authorization during the transmission via the Internet and cannot be changed without authorization.

Programs which distribute themselves independently or are sent via e-mails in the Internet and can cause damages to the PCs of the users.

Trojan horses:

Programs which, unnoticed by the user, carry out functions which are critical for the security, such as e.g. the intercepting of passwords.

“Phishing” attacks:

Pretending the serious origin of e-mails or Internet addresses in order to obtain personal data of the user.

Hacker invasions:

Unauthorized persons invade the PC of the users via the Internet.


Co-reading, changing and deleting of data during the transmission.

A host of security measures were already taken on the part of Oxyvital for these websites. In order for these precautionary measures to be able to be effective users must also contribute to ensuring that the systems used by the users are sufficiently protected, the data are transmitted safely and abuse is therefore prevented.

6. Choice of law and place of jurisdiction

The laws of SAR Hong Kong, China shall apply. Place of performance and place of jurisdiction is – insofar as permitted by law – the registered seat of Oxyvital. The English version is applicable.
